PRIVACY POLICY

This Privacy Policy describes how Aerosports Parks ("Aerosports", "we", "us" or "our") collects, uses, discloses and protects your personal information when you visit our website at www.aerosportsparks.ca (the "Site"), book a visit or party, sign a waiver, purchase a membership or pass, visit one of our parks in Scarborough, Oakville, London, St. Catharines or Windsor, Ontario, apply for a job with us, or otherwise interact with us (collectively, the "Services").

We are committed to handling personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws. Our electronic marketing practices are governed by Canada’s Anti-Spam Legislation (CASL), and our telemarketing practices comply with the CRTC Unsolicited Telecommunications Rules, including the National Do Not Call List rules.

We may update this Privacy Policy from time to time. When we make a material change, we will post the revised policy on the Site and update the "Last Updated" date above. Your continued use of the Services after a revised policy is posted means the revised policy applies to your information from that point forward, to the extent permitted by law.

1. Personal Information We Collect

"Personal information" means information about an identifiable individual. We collect personal information directly from you (for example, when you book online, sign a waiver or subscribe to our emails), automatically through your use of our Site (through cookies and similar technologies), through video surveillance in our parks, and occasionally from third parties (for example, when a friend or family member books a party that includes you or your child, or when you purchase through a third-party voucher platform such as Groupon).

We limit our collection of personal information to what is reasonably necessary for the purposes described in this Policy. If we need to use your personal information for a new purpose not described here, we will seek your consent unless the use is permitted or required by law.

2. Marketing Communications and Your Consent

We would like to keep you informed about promotions, events, new attractions and special offers. This section explains how we obtain your consent, how we use your contact information for marketing, and how you can withdraw consent at any time.

Email and Text Message Marketing

In accordance with CASL, we send commercial electronic messages (emails and text messages) only where we have your express consent or where implied consent exists under the law, such as within two years of a purchase or membership (an "existing business relationship") or within six months of an inquiry you make to us.

  • How we obtain consent. When we ask for your express consent (for example, through a sign-up form on our Site, at a kiosk in one of our parks, or during the waiver or booking process), we identify who is asking, explain what you are signing up for and make clear that you can unsubscribe at any time. Consent to receive marketing messages is never a condition of purchasing our Services.
  • What our messages contain. Every marketing email and text message we send identifies Aerosports Parks as the sender, includes our contact information and contains a clear unsubscribe mechanism.
  • How to unsubscribe. You may unsubscribe from marketing emails by clicking the "unsubscribe" link in any marketing email. You may opt out of marketing text messages by replying "STOP" to any message. We process unsubscribe requests without delay and in any event within 10 business days as required by CASL. We may send one final message confirming your unsubscribe request.
  • Transactional messages. If you unsubscribe from marketing, we may still send you non-marketing (transactional) messages, such as booking confirmations, waiver links, safety information, schedule changes and account notices. These messages are not subject to marketing consent because they are necessary to provide the Services you requested.

We keep records of when and how you provided consent, and of unsubscribe requests, in order to demonstrate compliance with CASL.

Telephone Marketing

If we place marketing calls, we do so in compliance with the CRTC Unsolicited Telecommunications Rules. We do not place marketing calls to numbers registered on the National Do Not Call List unless an exemption applies, such as an existing business relationship with you or your prior express consent. You may ask to be placed on our internal do-not-call list at any time by telling the caller, or by contacting us as described in the "Contact Us" section. Internal do-not-call requests are honoured within the timelines required by the CRTC and remain in effect regardless of your National Do Not Call List registration status.

Withdrawal of Consent

You may withdraw your consent to any marketing use of your personal information at any time, subject to reasonable notice and any legal or contractual restrictions. Withdrawing marketing consent does not affect our ability to provide you with the Services, and we will never refuse a booking or entry to a park because you have declined marketing.

3. How We Use Your Information

In addition to the purposes described in the table above and the marketing purposes described in Section 2, we use personal information to:

  • Operate our parks and provide the Services, including managing bookings, memberships, events and parties;
  • Administer waivers, manage risk and respond to incidents, injuries and insurance matters;
  • Provide customer service and respond to your questions and requests;
  • Administer contests, promotions and surveys you choose to participate in;
  • Analyze use of our Services to improve our parks, website, offers and guest experience;
  • Detect, investigate and prevent fraud, security incidents and violations of our policies;
  • Comply with legal, tax, regulatory and insurance obligations.

4. How We Share Your Information

We do not sell your personal information. We share personal information only in the following circumstances:

  • Service providers. Companies that provide services to us, such as booking and waiver platforms, payment processors, email and SMS delivery providers, website hosting, analytics providers and marketing platforms. Service providers may use your information only to provide services to us and must protect it appropriately. Some of our service providers are located outside of Canada (for example, in the United States); where personal information is stored or processed outside of Canada, it may be accessible to foreign courts, law enforcement and national security authorities under the laws of those jurisdictions.
  • Within our organization. Among Aerosports locations and any affiliated or successor entities under common ownership, for the purposes described in this Policy.
  • Business partners. With promotional partners or third-party voucher platforms (such as Groupon or similar services) where necessary to fulfil a purchase or joint promotion you have chosen to participate in.
  • Legal and safety. With our insurers, legal advisors, law enforcement, courts or regulators where we believe disclosure is required or permitted by law, is necessary to respond to legal process, or is necessary to protect the rights, property or safety of Aerosports, our guests, our employees or others. This includes CCTV footage and incident records where relevant to an investigation or claim.
  • Business transactions. To a purchaser or successor entity in connection with a merger, sale, financing, reorganization or transfer of some or all of our business or assets, provided the recipient agrees to handle personal information consistently with this Policy or as otherwise required by law.
  • With your consent. For any other purpose disclosed to you at the time of collection, with your consent.

Consent and opt-in records collected for our text messaging program are not shared with third parties for their own marketing purposes.

5. Cookies and Similar Technologies

Our Site uses cookies and similar technologies (such as pixels and web beacons) to make the Site work, remember your preferences, measure Site performance and support our advertising. In particular:

  • Analytics. We use analytics services such as Google Analytics to understand how visitors use our Site.
  • Advertising. We use advertising technologies such as the Meta Pixel to measure the effectiveness of our advertising and to reach audiences who may be interested in our Services. These technologies may collect information about your visits to our Site and associate it with your accounts on those platforms.
  • Email measurement. We use web beacons in marketing emails to understand whether our emails are opened and acted upon.

You can manage cookies through your browser settings, including blocking or deleting cookies, and you can limit interest-based advertising through the settings offered by platforms such as Google and Meta, or through the Digital Advertising Alliance of Canada opt-out tool at youradchoices.ca. Disabling cookies may affect some features of the Site.

6. Children’s Privacy

Our parks welcome children, and we necessarily collect limited personal information about minor participants, such as names and birthdates provided on waivers signed by a parent or guardian. We collect this information from the parent or guardian, not from the child, and we use it only to administer waivers, manage safety and risk, and operate the Services.

We do not knowingly send marketing communications to children, and we do not knowingly collect personal information online from children under 13 without the consent of a parent or guardian. Our website and online booking tools are intended for use by adults. If you believe a child has provided personal information to us online without parental consent, please contact us and we will delete it.

7. How We Protect and Retain Information

We use physical, organizational and technological safeguards appropriate to the sensitivity of the information we hold, including access controls, staff training and contractual protections with our service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the event of a breach of security safeguards involving your personal information that creates a real risk of significant harm, we will notify you and report to the Office of the Privacy Commissioner of Canada as required by PIPEDA.

We retain personal information only as long as necessary for the purposes described in this Policy or as required by law. Certain records are retained for longer periods where necessary, for example signed waivers and incident records, which we retain in accordance with applicable limitation periods and our insurance obligations, and CASL consent records, which we retain to demonstrate compliance. CCTV footage is retained for a limited period and then overwritten unless it is required for an active investigation, incident or claim.

If you create an account, you are responsible for keeping your password confidential. Please notify us of any unauthorized use of your account.

8. Your Rights and Choices

Subject to limited exceptions under applicable law, you have the right to:

  • Access. Request access to the personal information we hold about you and information about how it has been used and disclosed;
  • Correction. Request correction of personal information that is inaccurate or incomplete;
  • Withdrawal of consent. Withdraw your consent to our collection, use or disclosure of your personal information, subject to legal and contractual restrictions and reasonable notice. Note that withdrawing certain consents may limit our ability to provide some Services;
  • Marketing opt-outs. Unsubscribe from marketing emails, opt out of marketing texts and register on our internal do-not-call list, as described in Section 2;
  • Complaints. Ask questions or make a complaint about our personal information handling practices.

To exercise any of these rights, contact us as described below. We will respond to access requests within the timelines required by PIPEDA, normally within 30 days. We may need to verify your identity before acting on a request, and in some cases the law requires or permits us to refuse a request in whole or in part; where we do, we will explain why. If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at www.priv.gc.ca or 1-800-282-1376.

9. Third-Party Websites

Our Site may contain links to websites operated by third parties, including social media platforms and voucher marketplaces. We are not responsible for the privacy practices of those websites, and this Policy does not apply to them. We encourage you to review the privacy policies of any third-party website before providing personal information.
